  • Payback Employer?

    A local restaurant (Jacksonville, FL) requires its wait staff to suggest that the customer purchase an appetizer. If the employee does not, and the customer requests one, the employee must pay for it themselves. Is this legal?

    Deductions

    In most cases, employers cannot penalize employees with a reduction of pay where the reason for the deduction is for the employer's benefit. I believe that the practice you describe, therefore, is questionnable. If the employer had authorization from the employee, gained possibly at the time he/she was hired, that the employee will pay for such an item, the deduction is legal but the employee must still make at least minimum wage.
