    Can a employer withhold an employee's check for money owed? The employee was renting a house from the employee then was given a month to move out. With the additional cost of finding a new place and rental trucks and such, the last month's rent was not paid. Now the employer is telling the employee that in order to receive his check he needs to pay $350.00 first. Is this legal?

    Doesn't sound it to me, though I have a feeling there are a few details missing from the post. The employee is free to file a complaint with the state DOL.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
