    I work for a medical facility. I worked 52 hrs one week then had a death in the family. Per facility policy, we get three paid bereavement days. Because I had overtime, I was not allowed to use my bereavement day on Friday. I then took Monday and Tues off. My bereavement has still not been keyed in because my supervisor is waiting to see if I have OT this week. My administrator told her to give me the time but my supervisor refused. Is this legal? I feel that I worked the time and am entitled to the OT as well as regular pay for the bereavement leave.

    I'm sorry for your loss.

    Overtime is due based on hours worked, not on hours paid. Bereavement time is entirely at the opt of the employer. There is no legal entitlement to bereavement time in any state.

    What does your company policy on bereavement time say?
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
