  • Final Paycheck Virginia

I worked a couple days and was let fired at the end of my shift one day.

They say I cant get my paycheck until the pay period.

    I am cool with that...

But they say they have to mail it to me.

I want to pick it up.

Is it a law that they have to mail it to me? Are they just being *******s?

I currently dont have an address anymore... So i need to pick it up.

    ANything i can do?

The law does not address this question. Virginia law neither requires nor prohibits the employer from mailing the check; neither does it require that you be permitted to pick it up.

In other words, this is entirely a matter between you and your employer, and you will have to work it out between you. The law does not take a stand either way.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

This is the only thing Va. law says re final paycheck on separation of employment. (nothing re mailing it or picking it up)

An employer must pay an employee who is discharged or terminated, who has quit or resigned, or who is laid off, all wage due on or before the date he would have normally been paid for the work. Virginia Stat. 40.1-29
Too often we underestimate the power of a touch, a smile, a kind word, a listening ear, an honest compliment, or the smallest act of caring, all of which have the potential to turn a life around. Leo Buscaglia
