    I have a question my employer will only pay hourly employees their regularly salary if they work over 40 hours a week. I usually work around 38 hours a week but occasionally I work more than that. They offer no overtime or additional compensation. Can they do this?

    Huh? "Hourly" and "salaried" are opposite pay methods, but that's all they are.

    What exactly do you do and what type of industry (not the name of it)?

        So, "salary" is really a misnomer. You are paid so much per hour worked, correct?

        As a nonexempt employee for an FLSA-subject employer, you must be paid overtime when you actually work over 40 hours in a workweek.

        When you ask the employer why you don't get overtime pay when you work over 40 hours, what is their answer?
