    I just found out that my 401K contributions that my employer has been deducting from my check every pay period have not been deposited in my 401K.


    Who do I file a complaint with or what form do I use to file a complaint?

    My employer was to match it 100% and has not deposited that money either.

    Does anyone know what percentage in interest that they need to pay? I have in writing where they were to match it 100%.

    No notification that they were not contributing to the 401K.

    First thing tomorrow run, do not walk, to the telephone and contact the US DOL. I don't have the phone number handy but you can go to www.dol.gov and look up your regional office.

    Not making 401k contributions is something employers can go to jail for.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
