    Hi, We have a employee employed on a 2 year contract as a teacher in a local church to conduct religous education. This employee has violated many of the code of conduct guidelines in the church. He was also caught stealing money from the church so police was called and they filed a case against him. We fired him based upon all such actions. He sent a letter from an attorney to file a $100K lawsuit that we didnt honor his contract and also for defamation of character. His contract states we have to give him a 90 day notice before terminating his contract. So we reinstated him for the time being. Now we don't have funds to pay his monthly salary and also he is creating lot of caos in the church by gathering crowds in his support and against the administration. He is not following any requests or demands from the administration anymore. Can we just give him his 90 day notice and find ways to pay his 90 day salary and get out of his contract somehow? If yes what reason we need to give in writing to keep us safe from any more litigation etc.?

    You REALLY need to have a Texas attorney review his contract.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
