    Empl. records 28 hrs,but works 40+& supvr pays xtra hrs in next pay when empl. isn't [email protected]?Reportable?

    It is never illegal to pay an employee for more time than they have worked, only to pay them for less time.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      A non-exempt employee must be paid at least min. wage for all hours (time) worked in the workweek & overtime when applicable but it is legal to pay more. (but not less)

        It sounds like the employer caught an error and paid it in the next payroll. Nothing illegal there.

          Agreed. Also, under federal law, the time accounting requirements are strictly on the employer, not the employee. If the time accounting is wrong under law that is between the employer and federal DOL. The employer has a legal responsibility under FLSA to 1) record time correctly, 2) pay minimum wage obligations, 3) pay overtime obligations, and 4) follow child labor laws. That is pretty much it. As stated, it is not illegal under FLSA to overpay someone. It may be legal under FLSA to underpay someone as long as MW/OT are not violated. The feds literally do not care about base wages paid in excess of MW as long as there is no MW/OT violations.

          Now states can have their own rules, which sometimes are more pro-employee then FLSA.
