Clearly the newer EEOC Regs allow for separate and unequal treatment of older retires along the narrow lines of health care benefits, lots below 65 vs less or none for those over 65 , Medicare eligible ( Whether one agrees or disagrees is a bit moot..it's the rules for now anyway. )

But at least on the surface the PA law and PHRC address the 40+ class as a class and make no such exception of unequal health care by class age split at 65 .. very little / nothing is published on point

Any clues or read on which way PHRC may lean as to unequal health benefits for retirement incentives to those over 65 vs slightly younger potential retires over 40 ? Or unpublished decisions/settlements
