  • What about "prior intent" Pennsylvania

    I work for a public service agency. Contract expired 18 months ago, but is still binding. Language in contract gives anniversary bumps at stated intervals effective 1-1-03. Employer states that Prior Intent during negotiations was for bumps to only be given for a 6-month period from 1-1-03 to 6-30-03. Some 6 month bumps have been given, some not. We filed a grievance but are being discouraged about pursuing to arbitration because of the strength of the Prior Intent argument...We were given offer that honors bumps earned thru 1-1-06--but with pay retro only to 1-1-06. Several new hires will not get increases promised by expired, but binding, contract. Is this Prior Intent argument for real? BTW, people who asked about why bumps were not paid were told that the contract had expired!
