  • Holidays and OT Pennsylvania

I am looking for info regarding OT in Pennsylvania. This past Monday, Memorial Day, was a holiday. On Wednesday, I worked a 14 hour day and have been told that I cannot get paid overtime wages because Monday was a holiday. Is that legal? This was not a personal choice day, sick day or vacation day. The entire company was closed.

PA does not require your employer to calculate overtime on a daily basis. In PA, and in almost all other states as well, you are not due overtime unless you have WORKED more than 40 hours in the week. Holiday pay does NOT count towards overtime calculations.

So working 14 hours in a day does not guarantee you overtime. Unless your total hours for the week minus your holiday pay exceeds 40, your employer need not pay you anything but straight time.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
