  • Vacation payout laws for public entity Ohio

    I handle HR for a public entity the question has arose as to whether or not we are required to pay out vacation time if it is not used. Currently we pay out unused vacation on an employee’s anniversary date and then add their new earned vacation based on the prior years’ service. I believe the board of directors wants to change to a use it or lose it policy is this legal?

    Use it or lose it policies are legal in Ohio.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
