  • Reduced Pay After Resgination **North Carolina**

My wife quit her job today with no notice, which is not required in North Carolina as it is an at-will state. When the owners of the business found out, they informed her she would not be paid at her regular rate for the last week she worked. The owners informed her she will be receiving minimum wage for her last week of work. Is this legal?

They can not make retroactive changes to pay, so generally she could file a wage claim once they don't pay her the full rate. One caveat would be if she ever signed a pay policy/employer handbook that stated that failure to give 2 weeks notice would mean a drop in pay to minimum for the last paycheck. If so, that would not be considered retroactive as they told her that prior to her earning those wages.
