  • Unemployment after FMLA and STD North Carolina

    I was terminated after 12 weeks out of work on FMLA and remained on STD for 16 weeks. I am now able to go back to work, but with limitations. With those limitations I could not go back to the same place I was working before. Am I eligible for unemployment?

    You'll have to ask the unemployment office in your state. It is too state and situation specific a question for a message board to to anything but guess.

    Go ahead and apply. The worst they can say is no, and if they say no, you're no worse off than if you never applied in the first place. There is no penalty for being wrong and it does not cost anything except a little time and perhaps a postage stamp.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      You "might" be eligible since you can do "some" work. However, the UI office may require that you be released for work without limitations - only they can say.
