    In NYC is it legal to threaten termination for only a few employees when all fall below average in the same area during evalutions?

    Unless the few have been singled out because of their race, religion or other protected characteristic, yes. In fact, I can think of situations in which it would be inappropriate to do anything else.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      what can we do?

      Is there anything we can do? Keeping in mind that other employees had a significantly lower rating, none of which have been threantened with termination.

        On the basis of what very few facts you have posted, no, there is nothing you can do. You have provided no evidence to suggest any laws have been violated.
