  • Meal Penalty in New York? New York

    Is there a meal penalty that must be paid to employees in the case where the employee did not take a break (at least 30 minutes) in a 8 hour shift?

    I know in CA you must pay for the break period in addition to the hours worked.

    Does the same apply in New York? .

    As far as I know, CA is the only one with the penalty provision, and I'm not sure they're going to have it much longer.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      CA has a court case that has been sitting in the CA Supreme Court for a long time now. This will be a big decision, assuming that TPTB ever get off their backsides and actually make a decision. Until then, CA employers should assume that the factsheet on the CA-DLSE are the rules. And non-CA employers should assume that CA rules (any CA rules) have nothing to do with their state's rules.
