    Hi guys:

    I want to inquiry about NY laws for paying sick time and vocation. Recently we have to let go of an employee.

    We notify him around Jan 3, 2009. He asked us to pay him for sick time and vocation.

    He started with us on Feb 2007. He already taken his sick days and vocation for the time period between Feb 2007 to Feb 2008 and Feb 2008 to Feb 2009.

    However, he say that he is entitle for 2009 benefits. He say that the benefits should restart at the beginning of each fiscal years.

    We don't have a written company policy but we do have an oral agreement that the sicks days and holidays are not automatic but must be earned by the amount of time you work.

    My question is that does the benefits start at the beginning of the year (Jan 1, 2009) or at the beginning of his employment ?
