  • Can an equipment lease agreement last longer than the Independent Contractor Agrmt?

    My husband is an independent contractor for a non-emergency medical transport company. His independent contractor agreement says it is valid one year beginning on 9/24/10, but we just noticed his van lease agreement says it begins 10/10/10. Can he be held to the van lease agreement through 10/9/11 even though he cannot work for them after 9/23/11 because he is no longer an independent contractor?

    Independent contractors are never covered by labor law, but rather by contract law only. Unless you are trying to argue that your husband was never an independent contractor, then labor law is off the table. What is left is contract law. Meaning take the contract to a local contract law attorney who will have to actually read the contract. It is not possible for people on a labor law website to give you a contract law answer because all contract law answers involve the words "read the contract".

    Could you clarify what you mean by even though he cannot work for them after 9/23/11 because he is no longer an independent contractor? That one point may be of interest.
