    Hello,
    I need to know if an employer has the legal right to terminate an employee who is currently on short term disability? The state is Massachusetts.

    There is no law in any state that prohibits an employer from terminating an employee who is on short term disability. But before I give you a blanket "permission", I'd want a bit more detail to better access any potential liability.

    How long has the employee been off work? Does FMLA apply? Is the termination due to the length of the absence or is it a business-related reason that just happens to fall during a period of disability?
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

        I don't. But the answer is going to be the same either way.

        And since she never came back to answer the question, it's a moot point.
