    If I know an employee is working with pain and it is not work related should I ask him to go to a Dr. and get a note stating he is ok to work and any limitation he may have, ie. lifting, standing, etc.. Also this employee is in his 70's and refuses to go to a Dr.

    Has the employee mentioned this pain to you? If not, unless you have a real reason to assume that he is in imminent danger of injuring himself, I'd leave it alone.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
