    It is my understanding is that according to Maryland law an employer may require documentation of an illness after a 3 day absence. My question is, can a company require documentation for a one day absence? If so, is it legal to selectively apply this policy to one employee and not another?

    I am being required to provide documentation for a one day absence, whereas another employee was not.

    Yes, they can require (it's not illegal) documentation for a one day illness. (unless you have a binding employment contract or CBA to the contrary)

    All employees do not have to be treated the same as long as you aren't discriminated against due to a protected "class" (ie age, religion, gender).

      There is no law which addresses this in MD at either one day or 3 days. Many employers make it a policy to only regularly request notes from a doctor after a certain length of time has passed but that is just their practice. A note may be requested at any time, except in the event that FMLA has already been granted and the absence is in keeping with the certification form. A note may still be required for non-FMLA qualifying reasons though, such as use of sick leave.
