    I started a new job a couple of weeks ago and my old employer, who laid me off because of financial struggles, reported on my background check that I had "stolen from the company and committed fraud". What are the chances of actually succeeding in a suit against her if I have a written recommendation from her and a statement from a third party with her comment regarding the reason I was "fired".

    The law is that it's not defamation if it's true. If it's not true and you can demonstrate damages, I'd suggest contacting a local attorney.

      Generally your former employer is free to offer whatever reference they wish. The caveat is that the reference must be truthful or represent what they believe to be truthful.

      IMHO if you were hired by the new company, I'm not so certain you have damages to claim. How have you been impacted financially by the "false" job reference?
