  • Vacation Time earned/accrued Maine

I have worked for my employer for over 1.5 years.
I understood when I was first employed that I would not receive my vacation time accrued until after the end of my first year of employment. But now it is into my second year of employment, and I'm being told that I can't have my additionally accrued vacation time until the end of my second year.
Can my employer withhold vacation time that I have accrued? Can't I use it as I accrue it?
Is there a difference between accrued and earned? I don't get it.

There is no significant difference between earned and accrued.

However, in no state does the employee have the guaranteed right to use their vacation whenever they want. In all states, the employer can approve or deny the use of vacation time regardless.

This presumes that no legally binding contract or CBA expressly says otherwise.

You are in luck, though, since in ME any time you have not been able to use must be paid to you at termination.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
