  • Seeking Clarification, Unpaid hours Indiana

    If someone is scheduled to work 8 hours (non-exempt) and is tardy by 5 mins; can the employer refuse to pay 2 hours of pay for hours worked.

    Therefore, 8 hours scheduled
    5 mins late
    Therefore only working 7:55 hours
    Employer only pays 5:55 hours because of policy.

    I am fairly certain this is a W&H Violation. If so, what number should one report to Indiana?

    You need to be paid for all hrs. worked as a non-exempt employee. Your
    employer can discipline you in other ways including even firing you unless
    you have a binding employment contract to the contrary. They just can't
    withhold pay for hrs./time worked.

      You can, however, be disciplined in ways not relating to pay, up to and including termination, for tardiness. Even 5 minutes.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
