    Our company requires us to remain 6 minutes after the end of our shift unpaid. Our work day is now 8 hours and 6 minutes long.We are paid for 8 hours. We are paid for a 10 minute morning break, and a 20 minute lunch break. My employer justifies this by telling us we are only entitled to a 20 minute break, and we should be happy because we get an extra 4 minutes paid. 2 breaks=30 min. - 20 min. lunch + 6 min. overlap=26 min.
    Any ideas on the legality of this?

    So, if you had approval, you would get paid? Then the employer is being consistent. 6 minutes is considered de minimis by the Fair Labor Standards Act.

    We do not punch a clock, so we would not be paid if we started 6 min. early.
    We could write it in as a tenth of an hour, but without approval, we would not be paid.

    Actually, the FLSA guidelines allow for rounding to the nearest 15 minute interval, as long as the rounding is consistent. What happens if you start work 6 minutes before your scheduled start time?
