  • Stop Payment Charge for Lost Paycheck

    I am an independent contractor in Illinois who works for a police-training board. They say that they mailed my last check on the third of January (for work I performed in November!), yet I have not recieved it three weeks later. In order to have them mail another check they want me to pay a $25.00 stop-payment fee. It seems to me that it is their job to ensure I get paid and they should cover the stop-payment fee. Can they legally charge me?

    I don't know if there is such a law in the Illinois Wage and Hour statutes about this, but it wouldn't make any difference, as those laws do not apply to you as an independent contractor. The payment terms are whatever your contract states.
