    I have got a question, We got hourly employees that we issue vacation pay up to 4 weeks in Illinois. We have no sick pay, but allow them to use vacation pay for sick time, 1 day for each year of service up to 5. We need employees at work everyday. We do not tolerate people abusing sick days so after maximum allowed sick days they get unpayed and marked absent. 3 absentee's result in discharge. On saying that, we have employees with 3 or 4 weeks that do not want use their vacation for sick days and want to get unpayed. They want to take off when they want. Can we still mark them as absent and after three terminate. Also can we just pay them by using their vacation days anyway. What is the law on this, I cant find it anywhere or can you give me a link.

    Yes, you can consider it an unexcused absence and terminate.

    Yes, you can require that they take vacation days anyway.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
