    Is there anything special that needs to be done if we lay off and individual and then terminate him/her? For instance, we lay off a few people, most get jobs, so they arenít coming back, but others want to come back, but we donít want them to come back. Is there any issue with hiring different individuals to fill the open positions at a later date or is that discrimination?

    If you laid off everyone and hired back only white ones, that would be bad, unless you were able to show some non-discriminatory reason for hiring back only the whites.

    You can hire new folks without recalling those laid off. Expect your unemployment rate to suffer. It may be a good trade off.
