  • Restricting use of paid time off Florida

    I have several employees who have unused paid time off and would like to use it to make up for lost hours due to cutbacks. Obviously that will not help my cash flow problem...the reason for the cutbacks to start with. Can I hold back their time for use in the future? Our employment agreement does not address the "use" of the earned time.

    As long as there is no agreement covering the use of paid time, an employer in every state but CA and even sometimes in CA can limit when and how it is used.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
