  • Eligibility for CA SDI after misdemeanor conviction

My son was convicted of misdemeanor battery. He's due to be sentenced May 8. California SDI rules say you are ineligible if you are sentenced to custody in a care facility. But if the judge sentences him to time served and probation, does being in a dual diagnosis care facility (which is where he's going regardless) disqualify for SDI? He has a psychiatrist who is willing to sign the SDI application, and he was on SDI before he committed this (his first) crime (of course he was drunk at the time).

Does anyone know if a sentence of probation, without commitment to a facility as part of the sentence, is a disqualifier for CA SDI?
