  • Restaurant forced termination due to availability? Arizona

    I work in a restaurant. For school/study time reasons, I have a limited availability. I was hired as a part time employee. The availability I do provide is still full time if filled. If I gave notice of the hours was available to work, but was still scheduled for hours when I was not available, can I be fired for not showing up?

    Yes, your employer does not have to work around your school/study time even if notice of those hrs. was given. (unless you would have a binding employment contract guaranteeing only certain hrs. of work which I doubt you would in your case)

      Betty is absolutely correct. Arizona is an employment at will state giving an employer or employee the ability to terminate employment for any or no reason whatsoever.
      Not everything in America is actionable in a court of law. Please remember that attorneys are in business for profit, and they get paid regardless of whether or not you win or lose.

        All states are at-will employment states except Montana & even in certain circumstances there.
