    Ok here it is:

    My place of employment is open from 4:30 am till 1:30 a, almost 24 hrs. To be fair with scheduling, we get switched up every month.

    When I worked the mid shift, 8:30 am till 7 pm, I always got my lunch no earlier than 2 pm which is a half hr past the 5 hr mark. More often than not I would get my lunch about 2:40-3:00 range. This irritated me as I get irritable when hungry. I brought it up with management and they said this is our busy hours and we cant lunch everyone.

    Now im working the morning shift, 4:30 am till 3 pm shift. I am now getting my lunch at 7 to 8 am. This is only 2.5 to 3.5 hrs into my shift; which to me is too early. One manager likes to start lunches around 6, 6:30 but he wont ask me because he knows it would be an argument.

    I dont know if its important, but I get an hr lunch.

    So my questions are:
    1) should I take any retroactive actions for getting late lunches past the 5 hr mark?
    2) is it legal for them to lunch me 2.5 hrs into my shift? If so, am I entitled to any paid 10 minute breaks?
