  • Notice of Change in Employment Status (CA Section 1089) California

    I was told on 1/24/17 that my job duties were being reassigned and I was no longer needed for my employer. I assumed this to be a layoff although they never used that word.

    On 2/3/17, I received an email "Notice to Employee as to Change in Employment Status", outlining their official notification that my assignment ended and provided some links about unemployment programs available to me.


    Is there any recourse I can pursue for this being provided 10 days after I was let go? Am I entitled to waiting time pay?

    Also, they have provided no information as of time of this post, about my employer sponsored benefits, COBRA, CalCobra, or any other required items I must be notified about under Section 1089.

    Lastly, in the notice they stated I was discharged due to performance. This is the first time I've ever heard my performance had ever been questioned. I have yet to find out if there are any issues with my unemployment filing, but I'm now worried they may try to reject it.
