  • Is this illegal? North Carolina

My mother works at (deleted), and they work her to death. She wants to know if it's illegal for the company to force her to work overtime, and keep her from taking vacation days off. She currently has a situation where she's being forced to work during her scheduled vacation days. She also never takes her breaks, because they have her running other peoples jobs, including her own. She wants to know if there's anything she can do about this, anything she can do legally to prevent this from continuing any further.

    Thank you.

Unfortunately correct. Mandatory overtime is legal in all 50 states, and there are no circumstances (barring a contract or CBA that specifically says otherwise) under which an employer is required by law to allow an employee to take vacation, even if it was previously scheduled and approved.

Neither Federal nor NC law requires breaks.

I agree that it sounds like a poorly managed company but nothing you describe is illegal. Sounds like it might be time for her to dust off the resume.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
