  • Non-compete clause - Ohio

    Hi,

I left a consulting firm 6 months ago. Lets call them "Company A", I am considering joining a another consulting firm in the same city which does similar work (although it specialises is slightly different products). I signed a non-compete with Company A on joining. This is the contract clause:

"Noncompete Agreement: Mr <name>'s employment is contigent upon a non-compete agreement between <name> and <company>. During the course of Mr <name>'s employment with <company>, Mr <name> will not personally, or through anyone else, enter into an agreement that is in competition with <company> with a client. except through <company> for a period of two (2) years after the completion of an assignment."

To me it it looks like the "non-compete" was only valid while I was in their employment. Would that be correct?

    Thanks in advance!

Given that there could be language elsewhere in the document that amends or alters what is in the paragraph you quoted, we can't really say for certain.

You'd be better off showing the entire document to a lawyer in your state.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
