  • Using USERRA for Officer Training? Ohio

    I know someone in the reserves that is actively serving, and on a military leave of absence from work. He is going into eight months of officer training. Will his employer be obligated to hold his job open for him under USERRA? Or, would he be placed on a non-job-protected leave of absence the same as others on leave that are not covered by USERRA or FMLA at the company?

    USERRA regulations apply in this case.

      His job is protected by USERRA for up to five years, sometimes more.
