  • Holiday Pay during Unpaid Leave of Absence California

    Hi!

Does an employee have to be paid holiday pay while on an unpaid leave of absence?

    Thanks!

    No.

There is no requirement that an employer provide holiday pay at all, let alone during an unpaid leave of absence.

The ONLY exception, barring a bona fide contract or CBA that said otherwise, would be if you are an exempt employee AND the holiday fell in either the first or last week of the LOA AND you worked part of that same week.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
