  • PENNSYLVANIA - FROM FMLA -BACK TO WORK- NOW LONG TERM DISABILTIY? Pennsylvania

    My husband was out for heart problems in April. 2010 - he took the whole 12 weeks of FMLA. He went back to work in July 2010. In October 2010 was told that he can't go back to work due to his heart condition, depression from work, diabetic, etc. lots more.
    well to get to my question, when he took FMLA he has no short term disabilty so it went unpaid. Now in October, 2010 he is going to apply for Long term disability, which he paid for, we have very little knowledge about who the company is or anything. I wanted to know if anyone knows whether they will consider that 12 weeks off in the same calender year as the elimination period for the long term disabilty? November 5 will be his last check and we have no savings, actually, I just lost my unemployment, and am searching constantly for a job. So we are concerned if we can even pay for anything. Also he is salaried. Please help, answer. thank you.

    That really depends on how the LTD policy is written.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      Have him call his companys HR department and talk to the Benefit Specialist or HR Generalist, they should be able to give you all the information you need regarding the LTD.
