  • DISABILITY approved / denied Indiana

Was on short term disability from 5-14 to 6-4. All that time was approved. Doctor gave me a return to work slip to see if I could work. Work two days and was off for the same condition. And now they say my condition is not covered. My family doctor and the Specialist that i'm seeing have filled out paperwork for them and they still say not approved. Is there anything I can do to get what I got coming??

A return to work slip isn't used to SEE if you could work. It is used so that you can go back to work.

Now, what is the reason for the denial? What is the disability?

I don't see how that qualifies, either. How much time are you expected to be out?

        Are you eligible for FMLA?

FMLA makes perfect sense. How often do you get them? Is your medication working? How long have you been out? How long are you expected to be out? What additional paperwork was requested?

                  No, an insurance agent.

But, if you're working, you don't qualify for disability.

Short term disability: If your on STD and you return to work and go back off work for the same condition there is no waiting period. STD start again

That is a matter of the specific disability policy, Donn, not law.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

That's not what I mean. I'm saying that you CAN work right now. The FMLA part was easy. But, I don't understand why you're saying that you cannot work.

Are you at work now? What is the additional information that the insurance company needs?

No not at work now. I don't know what they want. They asked for all doctor's notes. Did that and they say thats not enough info. Don't know what more they could want. I don't see how group can make a decision to denied. When your doctor's say it a disability
