    I was working in the state of Tennessee. I was on medical leave.I went on medical leave in September 1999. On October 29, 1999 I was scheduled to be laid off. I returned to work on December 29, 1999. Can a company lay you off while on medical leave?

    Yes, your employer can, so long as the business function has been eliminated. If there are jobs similar to that which you held prior to your leave, int erms of compensation, working conditions and required skills, and you were on Family Medical Leave (FMLA), your employer must place you in that other job (assuming one is available).

    They cannot eliminate your job because you were on medical leave. 1999 was a long-time ago, in terms of employment law, and your ability to make a claim through a federal agency is no longer available. However, this information is for your future reference.
