  • I don't feel comfortable speaking in court. Can I have someone else speak for me? Minnesota

The right to represent oneself in court is protected in both the federal courts and in Minnesota. To look at the federal statute, 28 USC 1654, go to http://uscode.house.gov/search/criteria.shtml and enter the title (28) and the section (1654), without the parentheses, into the search boxes. The Minnesota unauthorized practice of law statute, 481.02, is online at http://www.revisor.leg.state.mn.us/stats/481/02.html. Both statutes, however, allow the courts to regulate who may act in a representative capacity for a litigant. If you plan to represent yourself, be prepared to speak for yourself.
