  • Chapter 13 Again

    I have made similar post....but I now have a new problem.

    On the way to church tonight our only car starting 'acting up'.
    Pretty sure it is the transmission. Probably $2000 to $2500 to repair.
    No way I can do this and make my payments to the court. ($825/mo)
    I have less than $100 in the bank.

    I have to have transportation to take my wife and myself to the doctor,
    get groceries,etc.

    I don't have confidence in my lawyer. I ask her earlier what I could to in
    a situation like this and she said 'if you don't make all the payments you
    will
    lose your house'.

    I would hate to lose my house but I am about to the end of my rope.
    We are in our high 60's with several health problems. Lupus, fibromyalgia
    diverticulitus, severe back problems, etc.

    What recourse do I have? Can I just try to get credit to get the car fixed?
    Can I ask to miss enough payments to get it fixed? What happens if I
    just quit making payments to the court? Will they dismiss the case or what?
    If I could get enough time I could refinance but I would have to do a little
    work
    on the house so........

    Any advise appreciated.

    Really need to know what would happen if I just quit making the payments to
    the court.
    Would I just be on my own against the creditors? Would this give me time to
    refinance
    and pay them off?

    I forgot to mention, I am in Georgia.

    Have about $60,000 colateral in my house.
    Owe $15,000 on the house and about $25,000 on the Chapter 13.
    Figure with a little work, house is worth, $90,000.

      On second thought, can you get a reverse mortgage on the house?

          It's where you sell your house back to the bank at a monthly rate!

          You could get them to pay you $400/mth until it's fully paid for.
