  • Question about a payment history Form

    I'm refinancing my home and the way my wife's old company paid the
    bankruptcy court was kind of weird compared to the way they were supposed to
    pay according to the way the payment schedule was setup.

    One month they paid X amount of dollars where the amount was 300 over the
    max, the next they paid and the amount was 400 over the limit and so on
    through the year so towards the end of the year we had already met our
    yearly max and they stopped paying.

    This was more than fine with the trustee of the bankruptcy, but now it looks
    like we missed a few months of paying over the years when our finance
    company asked for a payment history from the trustee.

    The trustee knows that we have a perfect payment history with them but
    refuses to fill out and sign a form that was sent to him from our finance
    company and hand carried to him from us stating that we have a perfect
    payment history with him and the court? There is no real reason why he is
    doing this other than to be a jerk from what we can tell? The woman at the
    finance company tells us that these forms are filled out and singed all the
    time by other trustees at the same bankruptcy court.

    My question is: Is there anything we can do to force this guy to fill this
    form out and sign it? We already have approval on our refinance of our
    house but it all hinges on this form being filled out and singed and that is
    the only thing keeping us from being able to drop several percentage points
    on our mortgage and being able to pay off the bankruptcy early.

    You would think the trustee would just fill this out and sign it so everyone
    could get there money early and be done with this, wouldn't you?
