A whole shift of mine was cut, due to what manager said was cut backs in hours for the weekend. Well, the only hours that were cut were mine. I am on workmans comp. due to an elbow injury. Are ther any laws protecting me? I fee :( that if I let this go, she will continue to cut hours here and there. I know that I can not do as much as my other co-workers due to my arm, but I still have rights, Right? I am located in Ventura County, CA.

It is illegal to retailiate against a person for filing a workers' compensation claim in California. It sounds like you are implying that the reason for hours change is as a result of retaliation. well you would have to have payroll to figure out what your average weekly wage was at the time of injury and if you go back to work and dont make that average weekly wage you could get a supplemental check from the insurance carrier. You just can't make over that average weekly wage or you will have to pay back the difference to comp. I think that is how it works in NY
