Mother says kidnapped baby is hers

“I know it is my baby. How can a mother not recognise her own flesh and
blood?” For Vidya Chavan there’s still hope that she may be able to adopt
the baby boy that she insists is hers but DNA results say otherwise.

The Bombay High Court has refused to order another DNA test. However, it has
asked the adoption court at Asha Sadan to consider the application of the
Chavan couple, whose new-born baby was kidnapped from J J Hospital last year.

The division bench of Justice V G Palshikar and Justice P V Kakade have asked
the authorities to disregard the couple’s financial condition.

At their one-room tenement in Walpakhadi, behind J J Hospital, the family hopes
their first-born child will be back home soon from the orphanage.

“The last one year has been sheer agony for us,” said Vidya. “I would
have been happy if the court had reordered a DNA test to confirm the baby is
mine.”

Vidya had given birth to a boy on January 11, 2003. Five days later, the baby
was kidnapped from the post-natal ward of J J Hospital. Two days later, a baby
boy was abandoned by its supposed Delhi-based parents at the hospital, which
Vidya claimed was hers.

The DNA results, however, proved the abandoned baby did not match with the DNA
samples of the Chavan couple. The boy was sent to Asha Sadan orphanage, while
the Chavans moved the high court for the child’s custody.

The Chavans’ counsel Madhvi Deshpande disputed the DNA test. “The hospital
authorities did not follow proper procedures for conducting the tests. The
blood samples were kept at the hospital for over three days before being sent
to the Hyderabad forensic laboratory,” claimed Prakash Chavan, Vidya’s
husband.

Though the Chavans are ready to adopt the child, the authorities are citing the
couple’s poor financial condition and have stonewalled their efforts.

Prakash does not have a permanent job, while the family stays in a rented
chawl. “We will raise any amount that the authorities want to show we are
earnest,” said Chavan. “Is money the only consideration for adopting a
baby? Does our love as parents not matter?”

The high court has asked the adoption authorities not to lay emphasis on the
couple’s financial condition.

The judges have also directed that the baby should not be given in adoption to
anyone till the Chavan couple’s application is considered.
