I have worked for the same place for the past 2 years. I have never had any write ups, no type of disciplinary action. Last monday I was called into the office and put on a final warning. I still dont quite understand why but from what I gathered it was for professionalism for talking to my mom who also works there on break one day about my hours and for discussing one of my csr's stats with another sup who was about to become this csr's sup. This final they said will be with me for the remainder of my employment, as a sup this means that i can not apply for another position at this company (even if it was a demotion) and I also cant recieve any of my bonuses. I guess my question is how can i go from not having any write ups to having a final and how can it remain with me until i either quit or get fired when the handbook says a final will remain with you for 120 days?

Prior written warnings are not required by law. If this was occurring previously and you didn't receive warnings before, that's not terribly good management, but it's not illegal. Neither is the warning "staying with you" for longer than the employee handbook provides for. In fact, if you received a warning for something you shouldn't have been doing, it should "stay with you" because they can discipline you if it does at any time. Not that you would necessarily do this, but some employees will go right back to the unacceptable behavior once their "probationary period" has ended. And neither do they have to let you apply for higher positions.

If you're looking for someone to tell you any of this is illegal, sorry, but I can't do that.
