My husband has worked for a large corporaiton for 16 years. (seveal thousand employees). He went out on a long term medical disability for one year. He was recently released by his doctor to return to work. HR laid him off and said they had no work for him. He wsa told his position had been disolved and that the entire department was in the process of being moved to Salt Lake City.
The date of his lay-off was Nov. 5. On Nov. 5 the corporation posted his exact job as an available position. Can they do this??

Yes, they can. The reason is that his one year absence was longer than the time limits of the leaves that protects one's job. Let me know if you have any other questions.

I should have mentioned one other thing. Is he considered as being disabled? If so, he could claim discrimination on the basis of the disability if it appears that they hired a person to replace him who does not have a disability. Let me know if you have any other questions.
