View Full Version : Amending Small Claims Court Judgement

I recently won a judgement by default against a company in Small Claims Court.
Unfortunately, I haven't collected anything because apparently the "registered
agent" -- who is also the owner of the company -- did not put anything in the
company's name. The bank account is in his name personally.
Is there any way I can collect?
At this stage, is there any way I can change the suit to name him as well?
I live in Georgia.
Thank you to anyone who helps. I need help badly.

You always have to pay attention to WHO you are suing, even in small
claims court. On the other hand, I would not be surprised to find
that there is a simple procedure for summarily amending the judgment,
with some sort of notice to all affected, to substitute the true
name(s) of the judgment debtor or it's alter ego. On the other other
hand (lawyers have lots of hands), you should not be able to
completely change your case to another one against someone else
without a completely new lawsuit. You may have to consult a lawyer to
know which principle applies to your case.
