View Full Version : BK question! HELP!!!!!!!! please!

I had a good paying, high stress job, when I got behind on state and
federal taxes and incurred a student loan.

I had to leave my former profession and school, due to high stress
affecting my health. Now I live in a remote area and work odd jobs for
food and shelter. The job stress is reduced, but with the interest and
penalties that have accrued, I don't see myself even earning that much
money, during the course of the remainder of my life. I'm 53, now.

I'm getting the usual threats to garnish wages and take possession of
anything I might own, in the future.

If I had the money, I'd pay it all today. Or, at the very least, attempt
an offer in compromise. I anticipate getting a non-cash "W-4" job and
wonder if I'll be able to survive on what's left, after any
garnishments. And I'm wondering if I can afford to make payments to all
of the above agencies and still support myself And, would the interest
and penalties keep it growing, faster than I could pay it, anyway?

I've been told that a do-it-yourself BK, cpt. 7 is the way to go for
state and fed past taxes and for student loans.

I'm drowning out here and it looks as though the stress is catching up
with me, again! The intimidating phone calls and numerous threatening
letters don't help either!

I have no capitol, no "steady" income, no savings, to make an offer, or
retain an attorney. And I don't own anything worth more than $50.00. I'm
not officially disabled. Reducing my job stress was my own common sense
decision. Not a doctors "order". I live in California.

I don't know what to do!!! What is my next and subsequent steps??? I am
truly motivated to resolve this situation somehow, someway and SOON! But
right now all I have is a good brain and a willingness to learn and do
what ever paperwork is necessary and possibly $50.00 for materials.

Please HELP!!! Any and all input is both welcomed and appreciated! I'm
ready to take notes and action! Thank you, all who answer, in advance!!!

I don't believe taxes can be discharged and as for the student loan... good
luck. From all I've read here, filing it yourself is a bad idea.

first of all calm down, if you do not have anything then there is
nothing they can take

second on the IRS ask them for more time , tell them openly about the
situation, even explain your medical or stress problem. They can make a
deal , even reduce and they can give you moe time. They usually do if
there was no fraud involved.

Just do not put your head in the sand.

On the loans do the same.

Then, as you have internet access, search for a bankruptcy lawyer and
have a free consultation. Then search for legal aid or help in your
state. usually universities and even the local bar has a pro bono
service which does help, even if you have nothing.

Remember, the lenders do not loose much when you default, they get
mostly things regulated over taxes. They will work with you.

I believe that old tax debt greater than 3 (or is it 4) years can be
discharged if it was legally incurred and not from evasion or fraud.
I'm hoping to have old taxes discharged in my case, I should know in a
month or two.
