Following my lawyer's advice I left two department store cards (same
creditor for both) off of my Ch. 7 petition. The reason being that the two
cards were issued through my employer and I also used a legal plan through
my employer. According to representatives from my legal plan (I heard the
conversation myself when I was with my lawyer) I could file Ch. 7, but I
could not include the two cards issued by them. I thought this was illegal,
but since my lawyer said it was allowable that's how we filed.
After the 341 meeting I asked if there was a way to add the two creditors
without using the legal plan. I was willing to pay out of pocket. Her main
concern was not getting paid by the legal plan rather than doing what was
right for me. She also told me that since I started my bankruptcy with her I
have to do everything through her (I'm not allowed to file anything on my
own). I just received my discharge letter and I was wondering if it was too
late for me to somehow have these two cards included, with or without her
help.
Also, I'm not sure how true this is because I can't remember where I found
it, but I read once before that even if I forget to list a creditor, in the
Northern District of Illinois all debts are automatically discharged in a no
assets case whether they are listed or not. If that's true I don't have to
worry. How do I find this out? Also, one of the two cards left off will no
longer belong to my employer, since that division of the company has been
sold. Will that make things easier for me at all?
